This Plan Terms Agreement (“Agreement”) applies to your subscription to the A.I.R. by Lexvor Inc. (“A.I.R.,” “we,” “us,” or “our”) services. By subscribing to any A.I.R. plan, you agree to these terms, which supplement our Privacy Policy and Terms and Conditions.

This plan is available to both new and existing Lexvor users. This plan features prioritized network
services up to 2 GB of used cellular data, cellular data services are unlimited and are not subjected to shutdowns within reasonable usage and network abuse policies.This plan however is subject to network congestion and throttling once 2 GB of cellular data has been consumed in a single monthly cycle. Unlimited Hotspot Not included. Credit approval not required, deposit
may be required for device leasing, social security verification required for device leasing, activation
payment required.

Capable device required for some features. Not combinable with certain offers. Switching plans may cause you to lose current plan/feature benefits; ask a rep for details. Unlimited talk & text features for direct communications between 2 people; others (e.g., conference & chat lines, etc.) may cost extra. Some messages, including those over 1MB, use data and may be unavailable in some locations. Roaming: U.S. roaming and on-network data allotments differ: roaming speeds and usage capabilities may vary by location. High-speed data is US only; Users on this plan at the base level come equipped with unlimited talk, text, data, and hotspot services. Reasonable Use and Network Abuse policies apply.

Administrative Fees are applied. Activation: Fee of $0 applied for all new lines plus cost of plan $12 for a total Activation Charge of $12 plus taxes and compliance fees. Monthly plan charges are required to be prepaid at the time of purchase.
Monthly subscriptions will be set to the first day of the following month unless otherwise requested for an updated payment date. Financing: Users will make device payments using Affirm, no initiation payments required, only device taxes when financing a new device. Cash: Users will make a one time payment for
new device purchases, no initiation payments required only device taxes when purchasing a new device. Leasing: Indicated leasing payment required to be paid on a monthly basis, leasing agreement must be signed, initiation payment required. Initiation payments are formatted as a refundable deposit which must be paid at the initial time of purchase prior to the shipping of devices to the customer. Initiation amount is set at $599.00 per device which is a refundable deposit upon surrender of the Lexvor device in possession by the customer assuming the device is returned in good working condition free of internal or external damages. Device Leasing adds an additional $10 per month charge per device to the Total Monthly Charges. Additional regulatory fees apply to each line for government required fees applied to
each active line. Regulatory fees currently applied at $1.50 per month per line. This cost is subject to change. International coverage available with requisite plan, see terms and conditions as listed. Additional purchase and request may be required for some services and locations. elsewhere. Usage may incur additional fees in some countries as rates do vary. Service may be terminated or restricted for excessive roaming. Not for extended international use; you must reside in the U.S. and primary usage must occur on our U.S. network. Devices must register on our U.S. network before international use. Videos stream capable at 480p quality. Some users may need to request for enhanced video streaming depending on activated plan type. Optimization may affect speed of video downloads; does not apply to video uploads. For best performance, leave any video streaming applications at their default automatic resolution setting.

This plan is available to both new and existing Lexvor users. This plan features 100GB of prioritized network services cellular data, cellular data services and is subjected to
shutdowns within reasonable usage and network abuse policies.
100GB of Prioritized Data and Hotspot included, Hotspot will be reduced to 100MBPS after and
20MBPS during times of network congestion.
Credit approval not required, deposit
may be required for device leasing, social security verification required for device leasing, activation payment required.​

Services & network coverage

Each individual plan is subject to its own set of plan provisions and available services.
​
Suspension or termination
​
We reserve the right to issue a warning and to suspend or terminate your service and access to the www.lexvor.com website or any other website we operate or to our service at any time if we
determine in our sole discretion that you have violated the Terms of Service or any of our rules or
policies or for any other reason in our sole discretion. Lexvor reserves the right to terminate these
Terms of Service and your access to the Services immediately and without notification.
For a Credit Card chargeback, if the chargeback is not resolved and reversed, your account will be deactivated and we will assess you a termination charge equal to the balance in your account, which is not refundable. If your account is reactivated subsequently, you may be charged a fee for each chargeback.

Abusive or aggressive behavior including communication (whether verbal or written) or sharing of content that may cause our staff to feel afraid, threatened or abused and may include threats,
personal verbal abuse, derogatory or lewd content, and rudeness is also unacceptable to us. We
also consider inflammatory, racist, and/or sexist statements, remarks of a discriminatory nature, and unsubstantiated allegations, to be abusive behavior. Where a customer is aggressive, abusive, or hostile, we may decide to:

● Advise the customer that we consider their actions offensive, unnecessary and unhelpful and
ask them to stop

● End telephone calls/appointments/meetings/ chats;

● Terminate all direct contact with the customer;

● Suspend or terminate your service and access to the www.lexvor.com website or any other
website we operate or to our service;

● Notify the police. This will always be the case if physical violence is used or threatened; and

● Take any other action that we consider appropriate to the circumstances.

Reasonable Use Policy
​
Lexvor's service is a personal voice/text/data service designed to deliver non-commercial customers with "normal" usage levels and patterns. "Normal" refers to the levels and patterns of at least 95% of our customers on a particular plan. Usage outside of normal, subjects the user and all associated lines with disconnection, suspensions, or limitations. Usage such as this is deemed as Network Abuse and is a violation of Lexvor terms. In the event a line is limited, suspended, or disconnected this does not absolve any owed remaining balances and balances must be paid in full for the services that were used and rendered.

Lexvor’s unlimited plans and features are for normal personal, non-commercial use and are device specific, unless prior written authorization from Lexvor is received. Unauthorized or excessive use beyond that normally experienced by typical user may create network congestion that will manifest itself in increased network congestion, busy signals for themselves and others, and may result in service termination. In fairness to all Lexvor users, Reasonable Use policies and usage consumption of Lexvor users will be monitored and enforced to prevent Network Abuse to maintain network quality for Lexvor users across all plans and services. Use of Lexvor's multi-line discounts for the purpose of reselling service and generating revenue from said service is strictly prohibited, and will result in service termination.

Lexvor evaluates customer usage in comparison to typical levels of permissible usage engaged in by legitimate customers.
​
Each of the following is impermissible under Lexvor's terms of service and considered outside of
normal use:
​
● operating a call center

● resale to others

● auto-dialing or fax/voice blasts

● telemarketing

● without live dialog, including use as a monitor, intercom or for transcription purposes

● Use services such as but not limited to VPNs, Proxies, and any other services that may allow
users to abuse the Lexvor services outside of the given parameters of any plans or services.
For Voice Call SMS, MMS, network Data, and Network Hotspot services, users who are exceeding
the mass of 95% of Lexvor users usage patterns in a month a monthly cycle may be deemed
Network Abuse in accordance with Reasonable Use policies. Unusual usage patterns in terms of
unique numbers called, high call forwarding/transferring usage and so on. A customer's aggregate usage may be considered outside of normal use if it exceeds the mass of 95% of Lexvor users usage patterns in a monthly cycle. IN COMBINATION with one or more of the following, including, but not limited to, excessive:

● unique numbers called

● call lengths

● call forwarding/transferring

● conference calling

● short duration calls

● number of calls made during a month

● number of calls made to a conference calling service during a month

● number of calls made during business hours

● number of calls terminated and re-initiated consecutively, which, in the aggregate, result in
excessive call lengths during a specific time frame

● other abnormal calling patterns indicative of an attempt to evade enforcement of Lexvor

● Excessive sent and/or received SMS messages

● Excessive sent and/or received MMS messages

● Excessive network cellular Data services in a monthly cycle

● Abnormal usage spikes that are indicated by a significantly high usage consumption in a
relatively short period of time for network cellular Data

● Excessive network cellular Hotspot services in a monthly cycle

● Abnormal usage spikes that are indicated by a significantly high usage consumption in a
relatively short period of time for network cellular Hotspot
Based on such a combination, Lexvor may determine that abnormal, unreasonable or impermissible usage is occurring when compared to typical customers on the same plan, and may take appropriate steps to enforce the Terms of Service.

Lexvor may also determine that abnormal, unreasonable or impermissible usage is occurring, and
may take appropriate steps even if the number of minutes/texts/data used is not excessive, when a customer's calling patterns during more than one month reflect excessive:
​
● unique numbers called

● call lengths

● frequency of call forwarding/transferring

● conference calling

● short duration calls

● number of calls made during a month

● number of calls made to a conference calling service during a month

● calls made during business hours

● number of calls terminated and re-initiated consecutively, which, in the aggregate, result in
excessive call lengths during a specific time frame

● other calling patterns indicative of an attempt to evade enforcement of this Lexvor terms of
service

Acceptable use
​
All use of the Lexvor Services must comply with Lexvor' Acceptable Use Policy as stated herein.
Lexvor services are intended for single user use per line with usage being directed to solely the
intended user on their mobile phone. You may not use your phone or device, or our service, for any
illegal purpose, including to harass, threaten, abuse, defame or slander any individual or entity. You agree to comply with the AUP, as modified by Lexvor from time to time in Lexvor’ sole discretion. Any SMS or MMS messages that You send (a) will not contain any material that is unlawful; (b) will not violate or infringe any copyright, patent, trademark or trade secret or right of privacy or publicity or any other personal or proprietary right of any third parties; (c) will not contain any Unauthorized Code; and (d) will not include unsolicited email, email bombing, proxy email for the purposes of spamming, USENET spam and any and all forms of bulk unsolicited commercial advertising: This includes sending or receiving of mass unsolicited email (SPAM), the direct sending and receiving of such messages, support of such messages via web page, splash page or other related sites, or the advertisement of such services, the sending, return, bouncing or forwarding of email to specified user(s) in an attempt to interfere with or overflow email services, the use of dedicated services to proxy email unsolicited users, the use of dedicated services to act in concert with other services located inside and outside the network to achieve mass unsolicited email (SPAM) to unrelated third parties, the use of dedicated services to send, receive, forward, or post UseNet unsolicited email or posts. Bulk SIM orders are only shipped at the discretion of our internal compliance department to prevent misuse of SIM cards. 

When you buy and use our Services or any Devices you agree that you will not misuse or abuse our Services or Devices by doing, among other things, any of the following: (a) modifying your Device from its manufacturer's specifications; (b) activating a Device on a Service Plan or with a feature or product not designated for its use; (c) inserting a Lexvor SIM card into a modem, router, laptop, or other signal broadcasting device. Your Device uses a Lexvor SIM Card to access our Data Services.
You are prohibited from using a Lexvor SIM Card with any device other than a basic phone,
smartphone, or tablet device to access our Data Services. Lexvor's Data Services may not be used
in any manner that has the effect of excessively and disproportionately contributing to network
congestion, hindering other customers' access to the network, or degrading network performance by maintaining a sustained or continuous wireless data service connection or active wireless Internet connection.

(These violations will be deemed network abuse and will result in suspension, disconnection, or
limitation of the line.)
​
Other unacceptable usage that Lexvor does not want to be associated with include:
Child Pornography: We have a zero tolerance policy on child porn and we’ll turn you over to the
authorities and cooperate with them as much as we possibly can to help them in their investigation of your activity.
​
Interfering with networks, devices or services: This includes the use of dedicated services or network services for the origination or control of denial of service attacks or distributed denial of service attacks, the storage, distribution, fabrication, or use of malware including virus software, root kits, password crackers, adware, key stroke capture programs and other programs normally used in malicious activity, any activity associated with "phishing", or "pharming" (and all other cutsie variants of those activities) or systems designed to collect personal information (name, account numbers, usernames, passwords, etc.) under false pretenses and all activity related to illegally or maliciously gaining access to a system, device or network to which you do not have explicit permission to do so.

We may terminate your service without further notice if you violates this AUP. In most cases we
would notify you of an alleged violation of the Acceptable Use Policy before we took any action, but not in all cases. If we terminate your service, your account will be deactivated, you will lose your mobile phone number, and we will assess you a termination charge equal to the balance in your account, which is not refundable. You are solely responsible and liable for all use of Services by any user, even if such use occurs without your permission.

Porting numbers
​
If you wish to port any existing telephone numbers from another carrier to Lexvor, you must
complete the authorized porting process as defined by Lexvor; you agree to follow Lexvor's
then-current Policies. In addition to completing the authorized porting process, Lexvor may require
you to enter your current account's password before Lexvor can initiate a port request and obtain a Confirmed Port Date. The Confirmed Port Date will be established pursuant to industry and any
applicable regulatory standards; however, since the time required to port number(s) will be affected by the accuracy of information provided to Lexvor by you, as well as the actions of your pre-existing voice provider, Lexvor makes no assurances regarding the time required to port any number(s).

Mobile phone number
​
The mobile phone number we provide is for your use while you are a customer. If you cancel your
service or your account is deactivated, we may give your mobile phone number to another customer without notice (unless you transfer the mobile phone number to another telecommunications provider in accordance with applicable regulations). While we do not expect to change your mobile phone number, and such changes are rare, under certain circumstances, we may be required to change your mobile phone number; if we do so, however, we will notify you prior to any change.
 
Unlocking
​
On August 1st, 2014, President Obama signed a bill into law that again made it legal for consumers
to unlock their cell phones in order to take them to a carrier that best suits their needs. Almost all
unlocked phones that have a SIM card slot will work with Lexvor. Our goal is to help customers take
advantage of savings by moving to Lexvor's flexible and affordable usage plans.
If your phone is locked to a carrier, do not hesitate to reach out to us. While we don't unlock it
ourselves, our support team can recommend unlocking options for you.

Customer identity
​
Lexvor customers are prohibited from creating and using false subscriber accounts used to mask
real identities or to otherwise interfere with Lexvor's direct line of communication with the actual
users of our network and service.
In addition, customers are prohibited from creating multiple subscriber accounts used for
circumventing Lexvor's pricing, plans, discounts, or services.
Any subscriber accounts without unique, accurate, and verifiable customer identity information are subject to immediate line suspension without refund or prior notice.
Lexvor may require an Identity verification using a valid form of government identification that is
accepted by Lexvor and our system, a Social Security verification, as well as other verification
services including but not limited to email verification, phone number verification, address
verification.

Customer information
​
When you agree to the Terms of Service, you also agree to the terms of our Privacy Policy available
on our website. This policy may change from time to time and includes important information on
what data we collect about you, how we use this data and with whom we share that data.
In the course of providing service to you, we may collect certain information made available to us
solely because of our relationship with you, including information regarding the nature and type of
your service and the calls that you place and receive. We always will handle this data, which is
"Customer Proprietary Network Information" ("CPNI"), in accordance with Federal Communications
Commission regulations, federal consumer privacy laws and our Privacy Policy. We take reasonable steps to protect CPNI and your other personal information from unauthorized use or disclosure. We will not intentionally share your personal information without your permission.
We are legally and contractually obligated to cooperate with law enforcement in the investigation of violations of law. We may disclose to law enforcement authorities and governmental agencies any information, including your name, account history, account information or other transmission data properly requested by law enforcement.

Dispute resolution
​
We and you each agree to contact each other first with any disputes. You must contact us with any dispute by the means indicated on our website. Please provide a description of the problem, all relevant documents/information and the proposed resolution. We will contact you at the last address that you have provided us or on your mobile phone. We each agree to negotiate in good faith to resolve any dispute. If a claim proceeds in court, we each waive any right that we may have to trial by jury in any lawsuit or other proceeding to the extent permitted by law. To file a dispute with Lexvor and to reach a solution amicably to your grievance, please contact
customerservice@airbylexvor.com.

Limitation of liability, indemnity
​
We and you agree to limit claims for damages or other monetary relief against each other to direct and actual damages unless prohibited by law. You agree that we and our business partners are not liable to you or any third party for any indirect, special, incidental, consequential, exemplary or punitive damages of any kind, including lost profits (regardless of whether we have been notified that such loss may occur) by reason of any act or omission in our provision of products or services or under any legal theory, including fraud, misrepresentation, breach of contract, personal injury, product liability or any other theory. We assume no risk or responsibility for your use of any of content. We are not liable for (1) any act or omission of any other company furnishing a part of our service or any equipment provided for such service; (2) errors or omissions of our business partners; (3) any damages that result from any product or service provided by or manufactured by third parties; or (4) any unauthorized or disputed charges for our services that appeared more than 30 days earlier on your online account statement which you did not promptly dispute in accordance with the Terms of Service. You acknowledge that no fiduciary or other special relationship exists between you and us, by virtue of the Terms of Service or your use of our Services. You also agree we are not liable for missed voicemails or deletion of contacts from your address book, content, or lost messages from your voicemail system.

You agree to indemnify and hold harmless us and our affiliates and their respective officers, agents, partners and employees, from any and all liabilities, settlements, penalties, claims, causes of action and demands brought by third parties (including any costs, expenses or attorneys' fees on account thereof) resulting from your use of our products and services, or use of our products and services by another person who uses your mobile phone and/or our products or services, whether based in contract or tort (including strict liability) and regardless of the form of action.

Resellers, Dealers, and Intermediaries'
​
We do not allow resellers, dealers or other intermediaries to use our name and service without
written authorization from the Lexvor Compliance Department.
Prohibited reseller activities include, but are not limited to: (a) the use of our name and branding (b)
the ordering of SIM cards or phones with intention to resell or give away in connection with a related
revenue generating activity (c) any revenue generating activity related to Lexvor products or
services, such as reselling our SIM cards or activating Lexvor service for others in exchange for
money or services.

Effect of terms of service
​
These Terms of Service supersede all oral or written communications and understandings between
you and us with respect to our products and services and the terms under which they are offered
and provided to you. If any part of the Terms of Service is declared invalid or unenforceable, all other
parts of the Terms of Service are still valid and enforceable. No provision of the Terms of Service
provides any person or entity not a party to the Terms of Service with any remedy, claim, liability,
reimbursement, or cause of action, or creates any other third-party beneficiary rights.
Unless otherwise specified herein, any disputes of a legal nature, whether a claim, complaint,
arbitration demand or otherwise, shall be subject to the exclusive jurisdiction of the federal or state
courts located within the State of California. All legal cases will be under the jurisdiction of the State
of California Governing Law.

Applicable charges
​
The charges payable by you for Services, including, without limitation any amounts due with respect
to any applicable Mobile Device(s), are as provided in your service plan and these Terms of Service.
Except as expressly provided in these Terms of Service or your service plan, Lexvor may increase
any applicable charges upon at least thirty (30) days' prior written notice to you for changes to
normal network subscription services charges or fees. All rates and charges are subject to change
immediately if there is any Regulatory Activity. If any Regulatory Activity occurs, Lexvor reserves the
right, at any time with as much advance written notice as commercially reasonable and without
liability to Lexvor, to modify Services, charges, rates, promotions, terms and/or conditions of these
Terms of Service to conform to such Regulatory Activity; or if such Regulatory Activity materially and
adversely impairs the provision of Services, as determined by Lexvor, terminate these Terms of
Service.

In addition to the service charges invoiced by Lexvor, the Company also imposes a separate
Recovery Fee (“RF”) on certain plans. The RF is based on a sliding scale and can vary based on the
plan selected. The RF is a discretionary fee collected and retained by Lexvor to help recover and
defray certain costs the Company incurs, including:

1) Federal and state regulatory fees associated with Universal Service programs, the provision of
telecommunications services for the sight and hearing impaired, local number portability, and North
American Numbering Plan administration; and
​
2) Administrative costs, fees and expenditures related to compliance with federal and state
regulatory programs and annual FCC regulatory fee obligations; and
​
3) State and local transaction tax and 911 fee obligations associated with the provision of
telecommunications services.
​
The RF is not a government tax, or government-imposed fee.
​
Assignment
​
You may not assign your rights or delegate any of your duties under the Terms of Service without our
prior written consent, and any attempted assignment or delegation without such consent is void. We
may assign all or part of the Terms of Service or your debts to us without notice.
These Terms of Service, together with any attachments referenced in these Terms of Service,
including, without limitation, the terms of any applicable service plan, the acceptable use policy
posted at https://www.lexvor.com/privacy or any other addenda entered into from time to time, each
of which is incorporated herein by reference, constitute the entire understanding between you and
Lexvor. You are not relying on any affirmation of fact, description, or promise from (or purported to be
from) any person or entity, nor any other oral or written representation or warranty that is not
expressly included in these Terms of Service.

When you accept these Terms of Service, you are representing that you are at least 18 years old
and are legally able to accept an agreement. If you accept on behalf of any organization, you are
representing that you are authorized to bind that organization and, where the context requires, "you"
means the organization.

SMS Policy
​
By entering your phone number for use pertaining to Lexvor, you agree to receive text messages
from us and agree to the associated Terms of Service. These messages will be used for important
notifications, security confirmations, and other relevant notifications or promotions regarding your
use. This is a recurring subscription. You understand and agree that you will receive a confirmation
text message for each text message sent to Lexvor. Message Frequency may vary. Reply STOP to
cancel. Msg&Data Rates May Apply. If you experience any problems with opting out of the text
program, or if you need help or additional information related to the text program, please text "HELP
" to +1(866) 996-2281, call customer service at +1 (866) 996-2281, or email us at
clientservice@lexvor.com.

While the text program is complimentary, message and data rates may apply, and may be deducted
from your prepaid balance. All carriers including Lexvor, and any wholesale partner carriers are not
liable for delayed or undelivered messages. Lexvor is also not responsible for incomplete, lost, late,
or misdirected messages including (but not limited to) undelivered, incomplete or inaccurate
messages resulting from any form of filtering or otherwise by any other party or entity. Lexvor also
reserves the right, in its sole discretion, to cancel or suspend any or all of its text program, in whole
or in part, or your participation therein, for any reason, or without (a) any notice to participants of the
text program, including you, or (b) any obligation of Lexvor to offer or support any similar
replacement program or service.

2G and 3G shutdown
​
The 3G networks of all major national wireless carriers will be decommissioned in 2022 to free up
frequency bands for the faster, more efficient and more reliable 4G and 5G networks. 3G-only
phones will no longer be able to place or receive calls or access other data services, such as
emergency services. Lexvor will not be able to activate or render services for users who are using
devices that are using a 2G or 3G mode type.



 
Errors on Our Site
​
We try to be as accurate as possible, however we stress progress not perfection. Despite our best
efforts, should errors occur, please inform us and we will rectify the issue immediately. For any
reason presented, we may cancel your order or contact you for instructions on the order.
 
Payments and Cancellations
​
Paid Subscriptions can be purchased either by (1) paying a monthly subscription fee; or (2)
pre-payment giving you access to the Lexvor Service for a specific time period (“Pre-Paid
Period”). Payments can either be made manually each month or can be set up to be
automatically billed by LEXVOR INC.
Unless your Paid Subscription has been purchased as a Pre-Paid Period, your payment to Lexvor
(or to a third party through whom you purchased the Paid Subscription) will automatically renew
at the end of the subscription period, unless you cancel your Paid Subscription through your
subscription page before the end of the current subscription period. The cancellation will take
effect the day after the last day of the current subscription period. Refunds and reimbursements
cannot and will not be issued for days and services used even when canceling your plan. If you
would like to request a refund or reimbursement you can do so by expressing your written
quarrel to Lexvor directed to the corporate office located at Address: 19800 MacArthur Blvd
Suite 300, Irvine, CA 92612
However, if you cancel your payment or Paid Subscription and/or terminate any of the
Agreements before the end of the current subscription period, we will not refund any
subscription fees already paid to us. Subscriptions are automatically set to be charged on the 1st
of each month unless otherwise expressed and agreed upon for an either temporary, lasting
arrangement, or cancellation.
Lexvor may change the price for the Paid Subscriptions, Pre-Paid Period (for periods not yet paid
for) from time to time, and will communicate any price changes to you in advance and, if
applicable, how to accept those changes. Price changes for Paid Subscriptions will take effect at
the start of the next subscription period following the date of the price change. As permitted by
local law, you accept the new price by continuing to use the Lexvor Service after the price
change takes effect. If you do not agree with the price changes, you have the right to reject the
change by unsubscribing from the Lexvor Service prior to the price change going into effect.
Please therefore make sure you read any such notification of price changes carefully.

Late Payments, or Insufficient Funds
​
For any payments not received on the date due, a forty-eight (48) hour grace period is extended
before a suspension or hold is placed on the account. A suspension or hold may result on a loss
of access to the account. Once payment is brought current the access to the account will be
restored.
Notifications that payment is due will be made no more than once per month and no more than
seven (3) days before the payment is due.

Customer Support
​
For customer support with account-related and payment-related questions (“Customer Support
Queries”), please submit a ticket to our customer service department using the Customer Service
contact form on the About Us section of our website. We will use reasonable attempts to respond
to all Customer Support Queries within a reasonable time frame but we make no guarantees or
warranties of any kind that any Customer Support Queries will be responded to within any
particular time frame and/or that we will be able to satisfactorily answer any such queries.

Service Limitations and Modifications
​
Lexvor will make reasonable efforts to keep the Lexvor Service operational. However, certain
technical difficulties or maintenance may, from time to time, result in temporary interruptions.
To the extent permissible under applicable law, Lexvor reserves the right, periodically and at any
time, to modify or discontinue, temporarily or permanently, functions and features of the Lexvor
Service, with or without notice, all without liability to you, except where prohibited by law, for
any interruption, modification, or discontinuation of the Lexvor Service or any function or
feature thereof. Notwithstanding the foregoing, if you have prepaid fees for Paid Subscriptions
that Lexvor permanently discontinues prior to the end of the Pre-Paid Period (defined in the
Payments amd cancellations section), Lexvor will refund you the prepaid fees for the Pre-Paid
Period after such discontinuation. You understand, agree, and accept that Lexvor has no
obligation to maintain, support, upgrade, or update the Service, or to provide all or any specific
content through the Service. This section will be enforced to the extent permissible by applicable
law. Lexvor and/or the owners of any Content may, from time to time, remove any such Content
without notice to the extent permitted by applicable law.
​
Your Mobile Number and Porting
​
You may be able to transfer, or "port", your wireless phone number to another carrier. If you port
a number from us, we'll treat it as though you asked us to cancel your Service for that number.
After the porting is completed, you won't be able to use our service for that number, but you'll
remain responsible for all fees and charges through the end of that billing cycle, just like any
other cancellation. If you're a Prepaid customer, you won't be entitled to a refund of any balance
on your account. If you port a number to us, please be aware that we may not be able to provide
some services right away, such as 911 location services. You don't have any rights to your
wireless phone number, except for any right you may have to port it. After a line of service is
disconnected, for any reason, the disconnected Mobile Telephone Number (MTN) may not be
suspended or otherwise reserved and may not be able to be recovered.

Use of the Service by You
​
A. The Online Services are not intended for users under the age of 18, and we do not
knowingly collect personally identifiable information from users under the age of 18. Such users
are expressly prohibited from registering for the Online Services or submitting their personally
identifiable information to us, and from using portions of the Online Services for which
registration is required.
​
B. You shall ensure that all equipment, hardware, software, products and/or services you use
to access, visit, or use the Online Services do not disturb or interfere with our operation of the
Online Services, or impede or interfere with others' access, visitation and/or use of the Online
Services. We reserve the right, in addition to our other remedies, with or without notice, to
immediately disconnect from the Service any equipment, hardware, software, product and/or
services causing interference with us, our licensors, vendors, service providers, the Online
Services.

C. If you provide to us the number for a mobile or other device, or we obtain the device
identifier for a device you are using, you agree, represent, warrant, and guarantee that such
device is registered in your name and owned by you, or that you have permission of the device
owner(s).
​
D. Unless otherwise specified, the Online Services are intended for your personal,
non-commercial use only. You are solely responsible for all usage of, or activities on, the Online
Services by you and by those you authorize or allow to use or provide access to, the Online
Services.
​
E. You must comply with all local, state, federal, provincial, national, international, and
foreign laws, rules, and regulations in accessing and using the Online Services, and will
immediately notify us if you learn of or suspect a security breach or any illegal activity in
connection with the Online Services.

Managing Your Lexvor Account
​
There is only one authorized and appointed account holder on each Lexvor account. This account
holder is the sole user that is able to make changes and updates to that wireless account. This
user will be held responsible for wireless usages, billing, upgrading, device/service claims, and
all other account related acts. At this time Lexvor does not allow authorized users to be added to
process account related actions.
​
Government Taxes, Fees and Surcharges
​
Users must pay all taxes, fees and surcharges set by federal, state and local governments. Please
note that we may not always be able to notify you in advance of changes to these charges.
​
Term and Termination
​
The Agreements will continue to apply to you until terminated by either you or Lexvor. Lexvor
may terminate the Agreements or suspend your access to the Lexvor Service at any time,
including in the event of your actual or suspected unauthorized use of the Lexvor Service and/or
Content, or non-compliance with the Agreements. If you or Lexvor terminate the Agreements, or
if Lexvor suspends your access to the Lexvor Service, you agree that Lexvor shall have no
liability or responsibility to you and Lexvor will not refund any amounts that you have already
paid, to the fullest extent permitted under applicable law. To learn how to terminate your Lexvor
account, please contact us through your Lexvor account at lexvorwireless.com. This section will
be enforced to the extent permissible by applicable law. You may terminate the Agreements at
any time.
Any section listed below this section in the agreement, as well as any other sections of the
Agreements that, either explicitly or by their nature, must remain in effect even after termination
of the Agreements, shall survive termination.

Network Abuse and Management Policy
​
 
This Network Abuse and Management Policy ("Policy") outlines the guidelines and expectations for
users of Lexvor Inc. regarding the appropriate use of
our network resources. This policy aims to ensure fair and reasonable use
of the network and to prevent abuse that may adversely affect the service quality for other users.
Network Abuse Definition: Network abuse refers to any
activity or behavior that significantly deviates from the intended and
fair use of the network, causing disruption, congestion, or degradation of service for other users.
Examples of network abuse include, but are not limited to, excessive
data consumption within a short period that may impact the network's performance.
Data Plan Adjustment: Lexvor Inc reserves the right to review and, if necessary,
adjust the mobile plan of users engaging in network abuse.
This may involve changes to the user's data plan, including but not limited to data speed reduction, plan suspension, or migration to a more suitable plan.
The decision to adjust a user's plan will be made at the sole discretion of Lexvor Inc. based on an
assessment of the user's data usage patterns.

Examples of Network Abuse: Network abuse includes, but is not limited to, the following examples:​

1. Excessive Data Usage: Usage of an unreasonable amount of data within a short period, such as 25GB over a 2-day period or 100GB over a 1-week period

2. Unauthorized Use: Use of the network for activities that violate applicable laws or regulations, including but not limited to unauthorized access, hacking, or any form of malicious activity.

3. Resource Intensive Applications: Continuous use of resource-intensive applications that significantly impact network performance for other users.

Use for Commercial Purposes: Use of the network for commercial purposes,
such as running servers or providing network services to third parties
without explicit permission from Lexvor Inc.
Enforcement: Lexvor Inc. will strictly enforce this policy against
users engaging in network abuse. Enforcement actions may include, but are not limited to,
plan adjustments, temporary suspension, or termination of service. Lexvor Inc reserves the right to take appropriate legal action if network abuse involves illegal activities.
Reporting Network Abuse: Users are encouraged to report instances of
network abuse to Lexvor Inc. customer support. Reports should include
relevant details such as time, location, and description of the suspicious activity.
Review and Revision: Lexvor Inc reserves the right to review and revise
this policy periodically. Users will be notified of any changes, and continued use of the network
will be considered acceptance of the updated policy.
Conclusion: Lexvor Inc. is committed to providing a reliable and high-quality
network experience for all users. This policy is designed to ensure
fair usage and prevent network abuse that may impact the overall service quality.
Users are expected to adhere to these guidelines to maintain a positive and
efficient network environment.
 
Canceling Subscriptions
​
The subscription operates and applies on a month-to-month or year to year basis. If the customer cancels their
month to month subscription, they are required to pay for their subscription for the remaining month which may be
prorated for the used days of service at the discretion of Lexvor. Users must also nullify all outstanding
balances related to monthly service plans and/or devices in which the users are in possession that are
owned by Lexvor or have an outstanding balance that is owed to Lexvor. Users who do not fulfill these
obligations acknowledge the escalated proceedings that Lexvor may take to recoup its product(s) or
collect on outstanding balances such as having a users case submitted to a collections agency or legal
and or financial prosecution.
 
Billing/Payments
​
Even after a subscription term of month-to-months has ended, Lexvor still owns the device if that device
was procured through Lexvor. If financing through Affirm the user will not be required or demanded upon
to return the financed phone as the user will own the device in this scenario.; moreover, the customer will
continue to make month-to-month payments based on their selected wireless plan-.
Users may however be required to cover the remaining portion of the device financing
terms when financed under promotional rates and discounts.
​
Lexvor does not accept prepaid
credit cards for postpaid accounts as this payment method will generally be declined by our billing
systems; additionally, if the user places an order with a prepaid credit card, the order will be immediately refunded and will also be
canceled. Prepaid accounts may be allowed to use prepaid credit cards if the payment
is successfully processed. In the event the customer cancels their subscription and continues to be
charged, Lexvor will credit this charge back to the original account. The user agreement cannot be changed.
​
Fees & Rights To Charge Fees
​
Lexvor may at anytime these events occur charge the fees as follows:
Lost or Stolen Devices: In the event, you have lost a Lexvor owned device you must report it to Lexvor
within 72 hours. If you fail to do so you will be subjected to regular billing and fees as listed in your
agreement. In the event you lose a device and choose not to pay for a replacement device Lexvor will
suspend your active services at your request immediately and you will not be charged
for any month unused for network services. Device subscription charges will still be applied until the said
device can be (1) repaired (2) recovered (3) returned (4) properly investigated. Your monthly service cost
will continue to generate until your services are properly terminated. Lexvor has the right to investigate
each incident in the manner which Lexvor chooses. Your account will remain suspended indefinitely until
Lexvor has completed its own investigation. If and when Lexvor has completed its investigation and has
valid proof that the device was lost in a manner which may not be categorized as intentional, malicious or
heinous act, Lexvor will lift your suspension and you may choose to create a new
subscription. You may not be able to finance a new device through Lexvor if the
customer account handlings have been deemed as an intentional, malicious or heinous act. If the
device is lost and unable to be recovered, you may be due for the remaining finance balance charges and
up to the full device value. Lexvor does not have any jurisdiction over lost or stolen Affirm financed
devices. Lexvor will allow users to refinance a device through Affirm at full value to procure a device for
the users wireless services. Users may be able to temporarily lease a Lexvor owned device in a scenario
where a device is lost or stolen depending on stock availability and company discretion.
Lost and stolen devices may also be covered through a qualifying AKKO plan.
Payments Fees: If for any reason you have missed more than 30 days from payments due date, Lexvor
will charge you for the final day ending a 30-day cycle and proceed to deactivate (terminate) your
account. At this time you will be charged for the remainder of the subscription balance owed; including the
balance of the device which must be returned. If the device is not returned, the above statement applies.
Lexvor allows qualified customers to lease a device(s) from the platform; further, all monthly and/or initial
payments follow the same flat rate. ALL UNLIMITED PLANS: All Lexvor Wireless services subject to
terms and conditions in the Wireless Customer Agreement (Phone User Agreement | Lexvor). Advertised
monthly price includes monthly plan charge for talk, text and data & monthly per-line phone access
charge for access to such services.

OTHER RESTRICTIONS & FEES: Initiation/upgrade fee per line & deposit may apply.

Compliance Fee
​
The Compliance Fee is charged to cover Lexvor Inc's expenses associated with complying with various federal and state regulations, taxes, and fees. These include, but are not limited to: (i) state and federal Telecommunications Relay Service Programs, (ii) the Federal Universal Service Fund Program, (iii) a range of international, federal, state, municipal, local, and other governmental franchise, excise, public utility, and telecommunications taxes, fees, and charges currently in effect or enacted in the future, and (iv) additional costs incurred by Lexvor Inc. to adhere to government regulations and programs, which may not necessarily be taxes or fees required for collection by local, state, or federal governments.

to and from international countries, including over Wi-Fi, may be charged additional $.25/min. (no charge for Wi-Fi
calls to US, Mexico and Canada). Usage may be taxed in some countries. Service may be terminated or restricted for
excessive roaming. Not for extended international use; you must reside in the U.S. and primary usage
must occur on our U.S. network. Devices must register on our U.S. network before international use.
Mexico & Canada calling, texting and roaming is available with Lexvor network plans. Some international
services may need to be activated by request.

This plan is provide by request only. Not all request will be granted and or approved. Terms subject to
change. Global roaming plans are available strictly on a request basis and will be customized according to travel
itineraries and specific country international service rates. Users may request for a higher usage
international plan for their travels however they also acknowledge that this plan is associated with
increased charges. There will be an additional charge for usage that exceeds the monthly allotment.
International coverage may be limited to 2G, 3G and 4G in certain locations.
Speeds may vary based on location and service, and connectivity is not guaranteed.
Lexvor is not responsible for poor signal quality outside of the United States.
