1. Overview

This User Agreement (“Agreement”) governs your access to and use of all services operated by Air By Lexvor Inc. (“Air,” “we,” “us,” or “our”).
Air provides artificial intelligence–driven tools, SMS/RCS-based communication services, and partner-connected programs that allow users to complete tasks, earn rewards, and access deals via text.

By creating an account, enrolling in any program, or using Air in any way, you (“User,” “you,” or “your”) agree to this Agreement, along with our Terms and Conditions and Privacy Policy.

If you do not agree, you must immediately discontinue using our Services.

2. Company Relationship

Air By Lexvor Inc. is the primary operator of the Air platform.
Its strategic and technical partner, Lexvor Inc., provides telecommunications, data infrastructure, and billing support.

Together, both entities ensure the secure delivery and operation of Air’s AI systems and rewards programs.
All communications, data processing, and compliance obligations are fulfilled under this partnership.

3. Eligibility and Registration

To use Air, you must:
    •    Be at least 18 years of age or the age of majority in your jurisdiction.
    •    Possess a valid mobile number capable of receiving SMS or RCS messages.
    •    Provide truthful and accurate information during account creation.
    •    Agree to receive transactional and informational messages from Air.

You are responsible for maintaining the confidentiality of your account credentials and for all activities occurring under your account.

4. Description of Services

Air By Lexvor Inc. provides:
    •    AI-powered task automation through SMS, RCS, and web interfaces.
    •    Rewards programs that allow users to earn points, credits, and discounts on eligible transactions.
    •    Partner marketplace access, including shopping, booking, and product discovery.
    •    Secure communications routed through Lexvor’s telecom infrastructure.

Some features may require additional verification, consent, or purchase.

5. User Responsibilities

By using Air, you agree to:
    •    Use the Services only for lawful, personal, and intended purposes.
    •    Provide accurate information and update it as needed.
    •    Respect all intellectual property rights of Air and its partners.
    •    Maintain your own internet and mobile connectivity for access.
    •    Refrain from reverse-engineering, copying, or redistributing Air’s technology.

You are responsible for all activity conducted through your account or device.

6. Prohibited Conduct

Users may not:
    •    Engage in fraud, spam, or unauthorized use of Air’s systems.
    •    Upload or transmit harmful, obscene, defamatory, or illegal content.
    •    Use automated systems (bots, scripts) to interact with Air.
    •    Exploit or manipulate Air’s rewards or referral systems.
    •    Impersonate Air employees, partners, or other users.

Violations may result in immediate account suspension or termination.

7. AI Interaction Disclaimer

Air’s artificial intelligence features generate responses based on available data and user prompts.
By using these tools, you understand that:
    •    AI responses are informational only and may contain inaccuracies.
    •    Air does not provide professional, legal, or financial advice.
    •    You are solely responsible for decisions made based on AI responses.
    •    Air By Lexvor Inc. and Lexvor Inc. are not liable for errors, omissions, or damages arising from AI-generated output.

8. Rewards and Points Participation

When you participate in Air Rewards or related promotions:
    •    Points, credits, or tokens earned through Air have no cash value.
    •    Points may only be redeemed within Air’s verified partner network.
    •    Rewards and discounts are promotional incentives, not cash equivalents.
    •    Air reserves the right to modify, suspend, or terminate any rewards program at its discretion.

Fraudulent or unauthorized participation may result in account termination and forfeiture of points.

9. Communications and TCPA Consent

By registering with Air, you consent to receive messages (including automated or AI-generated responses) from Air By Lexvor Inc. and Lexvor Inc. at the number provided.
    •    Message frequency varies by user activity.
    •    Standard message and data rates may apply.
    •    You may opt out by replying STOP to any message.
    •    For help, reply HELP or email customerservice@airbylexvor.com.

Your consent to receive communications is not a condition of purchase.

10. Partner Programs and Third-Party Offers

Air partners with verified third-party merchants and service providers.
By engaging with these partners, you acknowledge that:
    •    Air does not control or guarantee third-party product quality or fulfillment.
    •    Transactions and warranties are governed by each partner’s own terms.
    •    Air may receive compensation, commissions, or affiliate revenue for qualifying purchases.

All partner-related transactions are between the user and the partner.

11. Data Collection and Privacy

Your data is handled in accordance with our Privacy Policy.
By using Air, you agree that:
    •    Your personal and transactional information may be collected for legitimate business purposes.
    •    Data is encrypted, securely stored, and used to improve Air’s Services.
    •    Air does not sell personal data to unaffiliated third parties.
    •    Certain anonymized data may be used to train and improve AI accuracy.

12. Ownership and Intellectual Property

All content, trademarks, and technology within Air’s ecosystem—including AI systems, software, and branding—are owned or licensed by Air By Lexvor Inc. and protected under U.S. and international law.

You are granted a limited, non-transferable, revocable license to access and use Air for personal, non-commercial purposes.

13. Payment Terms

If you purchase credits, subscriptions, or rewards:
    •    You authorize Air to charge your selected payment method.
    •    All payments are non-refundable, except as required by law.
    •    Promotional credits and points cannot be exchanged for cash.
    •    Prices and available plans are subject to change without notice.

Air uses secure third-party payment processors that comply with PCI-DSS standards.

14. Account Suspension or Termination

Air By Lexvor Inc. reserves the right to suspend or terminate your access at any time, without notice, if:
    •    You violate this Agreement or applicable law.
    •    Fraud, abuse, or suspicious activity is detected.
    •    Required by legal, regulatory, or network compliance standards.

Upon termination, all unused points, rewards, and access privileges may be forfeited.

15. Limitation of Liability

To the fullest extent permitted by law:
    •    Air By Lexvor Inc. and Lexvor Inc. are not liable for indirect, incidental, special, or consequential damages.
    •    Air is provided “as is” without warranties of any kind.
    •    Air does not guarantee availability, accuracy, or uninterrupted operation.

You use Air’s Services at your own risk.

16. Indemnification

You agree to indemnify and hold harmless Air By Lexvor Inc., Lexvor Inc., and their officers, affiliates, and employees from any claims, damages, or expenses arising from:
    •    Your use of Air’s Services,
    •    Your violation of this Agreement or applicable law, or
    •    Your misuse of any rewards or partner offers.

17. Dispute Resolution

This Agreement is governed by and construed under the laws of the State of Wyoming, without regard to conflicts of law.
All disputes must be resolved exclusively in the state or federal courts located in Wyoming.

By using Air, you waive any right to participate in class-action proceedings against Air By Lexvor Inc. or Lexvor Inc.

18. Amendments

Air By Lexvor Inc. may update this Agreement periodically to reflect product changes, new regulations, or legal requirements.
The latest version will always be available at www.airbylexvor.com/user-agreement.

Continued use of Air after updates constitutes your acceptance of the revised Agreement.
